JUBA – The court battle between controversial Facebooker ‘Mama’ Amira Ali and senior SPLM-IO member, Nyenagwek Kuol, has been transferred from Gudele Court to the high court, according to Nyenagwek’s lawyer, despite lack of sufficient evidence for the transfer.
Amira is currently facing a court case in which she is accused by the senior opposition official of defamation and ‘unfounded’ utterances against her family.
She was to appear before a Gudela court yesterday when Nyenagwek’s lawyer was ‘surprisingly’ informed yesterday that the high court has ordered for transfer of the case to the district high court.
“We were surprised by the referral of the case file from the Gudele Court today to the District Court, and the decision was issued by the high court judge without stating the referral request so that we could respond to the referral request,” Advocate Monyluak Aguer Rou told Sudans Post from Juba Thursday evening.
Monyluak said despite not being served with a copy of the referral request from Amira Ali’s defense team, they have learned as of recent that there were no sufficient reasons behind the request for transfer.
“We did not receive a copy of the referral request submitted by the defense to know the reasons for the referral, but we learned recently that there is no sufficient reason for the case to be transferred from its jurisdiction (Gudele Court) to the District Court,” he said.
He said he and his team are working to submit a request for cancellation of the referral order on the basis that there is no sufficient reason for transfer of the case from where it initially started.
“We will submit a request to the court to cancel the referral and return the file to the Gudela court as there is no sufficient reason for the referral,” he said, adding that “Decisions are appealed within a time limit of 15 days from the date of their issuance.”
