JUBA – The office of the Speaker of Central Equatoria State Youth Union has rejected the suspension by the State Minister of Culture, Youth and Sport, Dominic Jada, saying the minister does not have the constitutional mandate to suspend the Union’s Chairperson and secretary general.
On 30th May, State Minister of Culture, Youth and Sport, Dominic Jada suspended indefinitely the Chairperson and Secretary-General of the State Youth Union without citing any reasons.
In a ministerial order dated 30th May, Minister Rita Dominic Jada, suspended Charles Lado Daniel, the union’s chairperson, and James Sekwat Enosa, the secretary-general.
In a statement issued on Tuesday, the office of speaker said the minister has no right under the constitution to suspend any member of the executive or member of council.
“According to article 17 sub article 8, paragraph F of Central Equatoria Youth Union, only the council has the legal right to suspend the chairperson and any other executive member,” it said.
It said the minister has acted with ultra vires powers for it is only the council that suspends any member of executive.
“Noting that article 7 of what so called commissioner quoted by hon. minister has not been existing among applicable laws in the Republic of South Sudan,” it said.
“Without any reason cited, the minister acted ultra vires, as such, the ministerial order is null and void.”
The council advised the minister to acquaint himself with the Union’s constitution to avoid embarrassing himself in future.
Last month, National Minister of Youth and Sports, Dr. Albino Bol Dhieu issued a ministerial order suspending Chairperson of the South Sudan National Youth Union (SSNYU) Gola Boyoi Gola from his position with immediate effect and formed an investigation committee to probe the youth leader for allegedly writing to foreign leaders without the knowledge of the minister of the minister.
