JUBA – The Pan African Law Chambers LLP has filed a complaint with the East Africa Court alleging South Sudan’s National Security Service threatened a lawyer representing a detained former Juba official.
The alleged threats came after the lawyer filed a case regarding the official’s whereabouts.
The lawyer, Advocate Santino Wani Jada, represents Kalisto Lado, the former mayor of Juba City who was detained by the NSS last month. According to a letter dated April 26, 2024, two-armed NSS agents visited Advocate Wani’s office and demanded he withdraw the case filed with the East Africa Court.
“We are submitting a complaint concerning a National Security agent intimidating Advocate Wani in discharging his constitutional mandate of a matter of a client who sued the government of South Sudan for having infringed the fundamental and constitutional rights of former Mayor of Juba City Council Kalisto Lado,” the complaint letter states.
The law firm asserts that the security agent’s actions are unconstitutional and will not deter them from advocating for their client.
They cite provisions of South Sudan’s constitution that guarantee freedom from interference for those exercising legal duties.
“It is important to note the Advocate shall be allowed to speak and write for their clients. The litigation privilege protects the Advocates by preventing intimidation against them by individuals, government institutions including the Respondent Agents,” the letter adds.
Pan African Law Chambers LLP is seeking intervention from the East Africa Court to instruct South Sudan’s Attorney General to prevent the National Security Service from interfering with legal proceedings.
The firm also claims that the threats, if not addressed, will hinder the court process.
